Joe Nied Leaves Letter Describing Rein of Terror On East Cape

Sends it to American Consulate in desperate plea for help

Dear Mr. Huston:

The enclosed report contains the circumstances that reveals the level to which some people will go to prevent outside intrusion into their "domain". Additional circumstances not contained in the enclosed report have happened to others, who out of fear of retaliation, will not come forward to report them.

1. Peter and Pauline Roth, owners of the property, where the arson look place, said the McGonagals told them that they had their own vigilante group and took care of things in Zacatitos because the police didn't come out there. The McGonagals laughingly said they beat up Mexicans suspected wrongdoing who they "accidentally" threw in the cactus.

2. An Amcrican who is married to a Mcxican owns a camp ground, and a small cantina in Zacatitos. The McGonagles told her they didn't like her signs and when she didn't take them down, they burned them down. She is too frightened to testify.

3. Owners had their property damaged or stolern when they did not sign up for the McGonagle's home protection and security program offered to American residents though their company, Oceana.

4. An intimidating confrontation with the publisher of the Gringo Gazette, Carrie Duncan.

5. Warnings by a Zacatitos resident. Dr. Lynn Kramer to keep my Mexican workers off the roads and beaches in the area.

The enclosed report directly points to Gene Crane and Peter McGonagal as the persons who unlawfully entered private property and caused damage and a fire that could have taken the life of a Mexican worker. The above events all contain a common connection to the American McGonagals and their company, Oceana.

Our experience with the police showed a famliarity with the perpetrators that demonstrated favoritism. I drove the judicial police to Zacatitos in my truck because theirs was in the repair shop. When the police took Crane into custody, he directly implicated McGonagal. We went and found Peter nearby and, after a friendly greeting with the police, Peter returned to his work while Crane drove his own truck to the police headquarters with the police.

McGonagal insisted on his innocence, saying directly to me, "I wasn't involved, all I did was give Gene the fuel, drove him to the site and watched him burn the place." This was Peter McGonagle's original statement to me which has now undergone several versions to the police, the Roths, and Carrie Duncan. Still more incredulous was the filing of a health complaint by McGonagal and Dr.Kramer (a resident of Zacatitos, mentioned earlier) claiming they suspected there were cholera conditions at our construction site. The. Health department responded immediately and came onto the property with McGonagle and Crane (the perpetrators) and Dr. Kramer.

The Health Department examined the workers and the site and said there was no problem other than the portable toilet needed to be changed three times a week rather than twice, which the company normally did. This is harassment of myself and my workers by the same people who caused the damage!

I have also received several death threats. the first was by phone on March 7th, about 9;#0 AM. A male Gringo voice said, "Your life isn't worth anything in Mexico" and hung up. The second was on March 9th about 3:30 PM when I was on the construction site. My cell phone rang and a male Gringo voice said, "You make an.easy target" and hung up. The third is the attached notice 1 found on March 17th, which was placed in my truck parked in front of my house.

I live directly across the. street from Mayor. Agundez' house, which

has a 24 hour guard. No one saw anything. Do I believe the authorities will do anything? I have seen seemingly intelligent people dismiss lawful procedure in favor of vigilante tactics. I have seen that the victim must find and present the evidence of guilt to the authorities, who seem inconvenienced to act upon the facts.
